Terms of Service
Legal policies should receive final review from a qualified UAE lawyer before publication.
1. About These Terms
These Terms govern access to and use of auctions.naximum.com (the 'Website'), operated by Naximum Auctions Organizing L.L.C S.O.C, licensed by the Dubai Department of Economy and Tourism under Commercial Licence No. 1649115 ('Naximum Auctions', 'we', 'us' or 'our'). By accessing or using the Website, you agree to these Terms. If you do not agree, you should not use the Website.
2. Website Purpose
The Website provides general information about Naximum Auctions, its services for professional vehicle dealers and its Auction as a Service offering for businesses with vehicles to sell. Website content does not constitute a vehicle offer, auction result, purchase confirmation or binding transaction. Bidder activation, bidding, purchases, payments, vehicle handover, ownership transfer and disputes are governed separately by the Bidder Terms and Auction Rules and any applicable terms displayed in the Naximum Auctions app.
3. Our Role
Naximum Auctions operates an independent auction service connecting professional vehicle dealers with vehicles submitted by approved Auction Partners. Naximum Auctions does not purchase or own the vehicles offered through the service and is not the vehicle seller. Vehicle ownership transfers directly from the legal owner to the purchasing dealer. The responsibilities of Naximum Auctions, the Auction Partner and the Bidder for each transaction are governed by the applicable auction and transaction terms.
4. Intended Users
The Website may be viewed by the public. However, the auction service is intended only for professional vehicle dealers purchasing vehicles for trade or resale, whether operating as companies or individual traders. Accessing the Website or registering through the app does not automatically grant bidding rights. Bidder activation remains subject to the applicable identification, business-document and eligibility requirements.
5. Information and Accuracy
We take reasonable steps to keep Website information clear and accurate. However, services, features, availability, procedures and other information may change. General Website content should not replace the auction-specific information, inspection report, notices or transaction terms displayed through the Naximum Auctions system. If Website content conflicts with confirmed auction or transaction information in the system, the auction-specific information and applicable Bidder Terms and Auction Rules will apply.
6. Enquiries and Submitted Information
When submitting an enquiry, you must provide accurate information and have the authority to provide any information relating to a company or another person. You must not submit confidential, misleading, unlawful or third-party information without proper authorization. Submitting a dealer-support or partnership enquiry does not create an account, partnership, agency relationship or contractual commitment. We may respond using the contact details and communication channels you provide. Marketing communications will be sent only where permitted and may be declined or unsubscribed from at any time.
7. Acceptable Use
You must not:
- Use the Website for any unlawful, fraudulent or misleading purpose.
- Attempt to access restricted accounts, systems, data or functionality.
- Interfere with the Website's operation, security or availability.
- Introduce viruses, malicious code or other harmful technology.
- Use automated tools to scrape, copy or extract Website content without written permission.
- Collect information about other users, dealers, partners or employees.
- Impersonate another person or falsely represent your authority or relationship with a company.
- Copy or use Naximum Auctions branding in a way that suggests an unauthorized relationship or endorsement.
- Use the Website in a manner that infringes intellectual-property, privacy or other legal rights.
We may investigate suspected misuse and take any action reasonably necessary to protect the Website, its users and our services.
8. Intellectual Property
The Website and its content—including its name, logos, text, design, graphics, software, structure and original materials—are owned by or licensed to Naximum Auctions and are protected by applicable intellectual-property laws. You may view and use Website content for legitimate personal or internal business evaluation. You may not reproduce, modify, distribute, sell, publish, frame or commercially exploit it without prior written permission. Nothing in these Terms transfers any intellectual-property rights to you.
9. Third-Party Services and Links
The Website may link to external services such as app stores, messaging platforms, maps, social-media platforms, payment-related services or other Naximum websites. Third-party services are operated under their own terms and privacy practices. We are not responsible for their availability, content, security or operation. 10. Privacy and Cookies
Our collection and use of personal information are governed by our Privacy Policy. The Website may use essential, analytical or other permitted cookies and similar technologies as explained in our Cookie Policy. You should review both policies before submitting personal information or changing your cookie preferences.
11. Website Availability
We aim to keep the Website available and operating correctly, but continuous or error-free access cannot be guaranteed. We may update, suspend, restrict or discontinue any part of the Website for maintenance, security, operational or business reasons without prior notice where reasonably necessary. We are not responsible for access problems caused by internet providers, user devices, third-party services or circumstances outside our reasonable control.
12. No Professional Advice
Website content is provided for general information only. It does not constitute legal, financial, technical, valuation or vehicle-purchasing advice. You remain responsible for reviewing the applicable auction information and obtaining professional advice where necessary before making a business or financial decision.
13. Disclaimer and Limitation of Liability
To the extent permitted by applicable law, the Website is provided on an 'as available' basis without guarantees that it will always be uninterrupted, secure, accurate or free from errors. Naximum Auctions will not be responsible for indirect or consequential losses, loss of profit, revenue, opportunity, business or data arising solely from reliance on general Website content, Website unavailability or third-party services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. This section does not replace or reduce any responsibilities expressly accepted by Naximum Auctions under separate Bidder Terms, Auction Rules or confirmed transaction terms.
14. Your Responsibility
You are responsible for your use of the Website and for maintaining the security of the device, connection and contact details you use. To the extent permitted by law, you will be responsible for losses, claims or reasonable costs resulting from your unlawful use of the Website, infringement of another party's rights or material breach of these Terms.
15. Restriction or Termination of Access
We may restrict or block access to the Website where we reasonably believe that a user:
- Has breached these Terms.
- Is attempting to compromise Website security.
- Is using the Website unlawfully or fraudulently.
- May create a risk for Naximum Auctions, its users, partners or systems.
Any action affecting a registered account or bidding access will also be governed by the applicable account and Bidder Terms.
16. Changes to These Terms
We may update these Terms to reflect changes to the Website, our services, operational requirements or applicable laws. The updated version will be published on this page with a revised 'Last updated' date. Where appropriate, we may provide an additional notice of material changes. Your continued use of the Website after updated Terms take effect constitutes acceptance of those Terms.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. Subject to any mandatory legal requirements, the courts of Dubai will have exclusive jurisdiction over disputes arising from access to or use of the Website.
18. General Provisions
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply. A delay or failure by Naximum Auctions to enforce any provision does not waive its right to enforce that provision later. These Terms, together with the Privacy Policy and Cookie Policy, constitute the agreement governing use of the public Website. Separate terms apply to accounts, bidding, partnerships and vehicle transactions. These Terms may be published in English and Arabic. If the versions differ, the English version will prevail to the extent permitted by applicable law.

20. Bidder Terms and Auction Rules
These Bidder Terms and Auction Rules ('Terms') govern registration, Bidder activation, bidding and vehicle purchases through Naximum Auctions. Naximum Auctions is operated by Naximum Auctions Organizing L.L.C S.O.C, licensed by the Dubai Department of Economy and Tourism under Commercial Licence No. 1649115 ('Naximum', 'we', 'us' or 'our'). By activating a Bidder account or submitting a bid, you agree to these Terms and any auction-specific conditions displayed in the Naximum Auctions system.
21. Definitions
For these Terms:
- Auction Partner means an approved business that submits vehicles for auction.
- Bidder means an activated professional vehicle dealer authorized to bid.
- Bid means an amount submitted by a Bidder for a vehicle.
- Purchase means the transaction created after an auction result is accepted.
- Asking Price means the optional confidential price set by the Auction Partner.
- Working Hours means Naximum's operating hours from 10:00 a.m. to 7:00 p.m., Saturday to Thursday, excluding Fridays and UAE public holidays.
- Vehicle Handover means the inspection and acceptance process conducted at pickup or delivery.
22. Dealer-Only Service
Naximum Auctions is intended for professional vehicle dealers buying vehicles for trade or resale. It is not intended for end users purchasing vehicles for personal use. A Bidder may be a licensed company acting through authorized users or an individual recognized by Naximum as a professional vehicle trader. Naximum may request information reasonably required to confirm identity, business activity, authority, payment source or continued eligibility.
23. Registration and Activation
Anyone may register for a standard account, but registration alone does not permit bidding. To become a Bidder:
- An individual must submit valid identification.
- A company must submit a valid trade licence and details of its authorized representative.
- Any additional verification information requested by Naximum must be provided.
Activation may be completed after the required documents are received. Naximum may refuse, restrict or suspend activation where there are reasonable concerns about identity, authority, conduct, payment history or platform risk.
24. Account Responsibility
Bidders must provide accurate and current information and keep their login details secure. An individual Bidder is personally responsible for all activity and bids placed through the account. A company Bidder is responsible for every bid and action completed through its approved users. Each user confirms that they have authority to act for the company. Login details must not be shared. Access may be limited to the number of devices approved for the account. Suspected unauthorized access must be reported to Naximum immediately.
25. Security Deposits and Bid Limits
A security deposit may be required depending on the Bidder's profile. Naximum may also temporarily allow an approved Bidder to bid without a deposit. Where a deposit applies:
- The available deposit determines the maximum permitted bid for each individual auction according to Naximum's configured deposit limits.
- The limit applies separately to each auction and is not an aggregate purchasing limit.
- Naximum may require an additional deposit or adjust eligibility based on account activity and risk.
- Deposits do not earn interest.
- A deposit is not automatically treated as payment toward a Purchase unless Naximum confirms otherwise.
A Bidder may request a deposit refund when there are no active or binding bids, unpaid Purchases, outstanding charges, disputes or account investigations. Approved deposit refunds will be initiated within two Working Days. Additional bank processing time may apply. Naximum may deduct any amount validly owed under these Terms from the security deposit.
26. Vehicle and Inspection Information
Every auction vehicle must have an inspection completed by the Auction Partner under Naximum's inspection standards. The Auction Partner is responsible for performing the inspection and providing accurate vehicle information. Naximum may provide standards, training, monitoring and dispute resolution but does not perform the partner's original inspection unless expressly stated. A vehicle inspection records the vehicle's condition at the time of inspection, is not a warranty or guarantee of future performance, must be considered in relation to the vehicle's age, mileage and general condition, and focuses on material defects that may reasonably reduce value compared with similar vehicles of comparable age and mileage. Normal age-related wear, minor differences and matters based mainly on personal opinion may not qualify as inspection mismatches. The Bidder is responsible for reviewing the full auction information and inspection report before bidding.
27. Confidentiality and Non-Circumvention
The identities of Auction Partners, sellers and Bidders may be hidden during the auction process to protect the marketplace. A Bidder must not attempt to identify, contact or transact directly with an Auction Partner or seller for the purpose of bypassing Naximum or completing an auction-related transaction outside the platform. Identity information may be disclosed where reasonably required to complete payment, legal documentation, ownership transfer, dispute resolution or regulatory obligations. A breach of this section may result in bidding restrictions, suspension or account termination and may make the Bidder responsible for resulting losses.
28. Auction Operation
Auctions use open ascending bidding. Activated Bidders can see the current highest bid but cannot see other Bidders' identities. Each auction may have its own:
- Start and closing time.
- Minimum bid or starting bid.
- Minimum bid increment.
- Duration.
- Auto-extension period.
- Auto-extension trigger.
- Eligibility or deposit requirements.
The auction timer and records shown in the Naximum system are authoritative, subject to correction of a verified technical or administrative error. A bid submitted close to the scheduled closing time may extend the auction according to the configured auto-extension rules.
29. Binding Bids
Every submitted Bid is binding, whether or not it is the highest Bid when the auction closes. A Bidder cannot withdraw, reduce or cancel a Bid after submitting it. Naximum may correct or cancel a Bid only in exceptional circumstances, such as a verified technical or system error. Any correction remains at Naximum's discretion. A lower Bid may be selected if a higher Bidder defaults or does not complete the Purchase.
30. Validity of Bids After Closing
Every Bid remains binding for 24 hours after the auction closes. If a Bidder is selected within that period, the Bidder's purchase commitment continues beyond the 24-hour period until the Purchase is completed or validly cancelled. After 24 hours, Naximum may offer the vehicle to a lower Bidder, but that Bidder must reconfirm acceptance before becoming committed.
Bids are released earlier if the auction is rejected or cancelled.
31. Asking Price and Auction Acceptance
The Auction Partner may set an optional Asking Price. The Asking Price is confidential and is not shown to Bidders. If the Asking Price is reached:
- The auction will be shown as accepted.
- Bidding may continue until the auction closes.
- The highest valid Bidder at closing must complete the Purchase.
- The Auction Partner cannot later reject the accepted result.
Only Naximum may subsequently cancel the Purchase for a documented operational, legal, inspection or vehicle-related reason. If the Asking Price is not reached, or no Asking Price was entered, the Auction Partner may accept or reject the auction result within 24 hours after closing. If the Auction Partner does not decide within 24 hours, the auction expires and all Bids are released.
32. Purchase Creation
Once an auction result is accepted, the Auction Partner may create the Purchase. Naximum will normally create it immediately as the auction organizer. Before a Purchase is created, the Auction Partner may still reject a result that was not automatically accepted through the Asking Price. After a Purchase is created, only Naximum may cancel it, and the cancellation reason will be recorded.
33. Payment
The selected Bidder must submit valid proof of payment within six Working Hours after receiving the Purchase notification, unless a different deadline is clearly shown in the Purchase. Accepted payment methods may include bank transfer to Naximum's account, cash deposit into Naximum's bank account, cash payment at Naximum's office where accepted, or another method expressly approved by Naximum. Submitting payment proof within the deadline satisfies the Bidder's initial timing obligation, but payment is not considered finally received until the funds clear in Naximum's account or an official cash receipt is issued. Ownership transfer will not begin until Naximum confirms receipt of cleared funds. Naximum may request payment evidence, source-of-funds information or confirmation that the payment was made by the Bidder or its authorized company.
34. Amounts Payable
The Bidder must pay:
- The accepted winning Bid.
- Applicable government ownership-transfer charges.
- Any optional delivery charge accepted by the Bidder.
- Any default, administration, reinspection, redelivery, storage or dispute-related charges payable under these Terms.
Naximum does not add a buyer commission to the winning Bid. All applicable amounts must be displayed in the system or Purchase before payment or before the relevant additional service is provided. VAT will be added to taxable Naximum fees and services where required by UAE law. Government fees and third-party charges may be shown separately.
35. Managed Payment
Naximum collects the purchase payment from the Bidder and manages its settlement according to the applicable transaction arrangement. Naximum will not release the vehicle proceeds to the Auction Partner or seller until the Bidder accepts the vehicle at handover and ownership transfer is completed. Naximum does not purchase the vehicle or take ownership of it.
36. Pickup
A Bidder assigned the pickup option must collect and inspect the vehicle within six Working Hours after receiving confirmation that the vehicle is ready for pickup, unless another deadline is shown or approved. The Bidder must attend the designated location with the required identification, documentation and authorized representative. Failure to collect within the deadline without an approved extension may be treated as a purchase default.
37. Delivery
Delivery is currently available only to eligible company Bidders and remains subject to the delivery type configured for the account. Delivery charges may be fixed within the same city and may vary for other locations. The Bidder or its authorized representative must attend the scheduled delivery and inspect the vehicle immediately. Missing a scheduled delivery without an approved rescheduling may be treated as a purchase default. Additional redelivery, storage and administration charges may apply.
38. Acceptance at Handover
The Bidder must inspect the vehicle and either accept or reject it at pickup or delivery. Once the vehicle is accepted, the Bidder cannot later raise a claim concerning visible condition or inspection defects that could reasonably have been identified at handover. This does not remove any legal rights relating to ownership, fraud or a defect deliberately concealed from the Bidder.
39. Permitted Vehicle Rejection
A vehicle may be rejected only where the Bidder identifies a material defect or condition that does not reasonably match the original inspection information. A vehicle cannot normally be rejected because of normal wear appropriate to its age and mileage, minor defects that do not materially affect value, personal preferences or matters based mainly on opinion, a condition already disclosed in the inspection, a change in the Bidder's purchasing decision or expected resale value. The Bidder must submit the claimed defects and comments through the Naximum system at handover.
40. Dispute Process
Submitting a rejection creates a dispute case. Naximum may arrange a reinspection, request additional evidence and review information from the Bidder and Auction Partner. If the Bidder's claim is confirmed, the Purchase may be cancelled and the vehicle returned to the Auction Partner, or the parties may proceed with an agreed financial settlement. Applicable reinspection, return-delivery and related costs will be charged to the Auction Partner. If the Bidder's claim is not confirmed, the Purchase remains binding, the Bidder must accept and complete the Purchase, and the Bidder may be charged applicable administration, reinspection, delivery and storage costs. The Bidder agrees to comply with Naximum's final operational dispute decision, without limiting any rights that cannot be excluded under applicable law.
41. Ownership and Risk
Vehicle ownership transfers directly from the legal owner to the Bidder. Naximum does not appear in the ownership chain. Ownership and risk pass to the Bidder only after ownership transfer and physical handover are completed. Before both steps are completed, the Bidder must not drive, move, use or resell the vehicle without Naximum's authorization. After transfer, the Bidder is responsible for registration, insurance, transport, use and compliance with applicable vehicle laws.
42. Bidder Default
A Bidder may be considered in default if the Bidder:
- Fails to submit valid payment proof within the deadline.
- Fails to provide cleared funds.
- Refuses to complete an accepted Purchase.
- Fails to attend pickup or delivery.
- Fails to complete required ownership-transfer steps.
- Provides false documents or payment information.
- Otherwise materially breaches these Terms.
- Following a default, Naximum may cancel the Purchase, proceed with the next eligible Bidder, disable bidding until the issue is resolved, suspend or terminate the account, deduct valid charges from the security deposit, and recover outstanding amounts directly from the Bidder.
43. Default Charges
Default Compensation Fee. If the vehicle is subsequently purchased by another Bidder for a lower amount, Naximum may charge the defaulting Bidder the positive difference between the defaulted Bid and the completed replacement purchase amount. No difference is charged if the replacement amount is equal to or higher than the defaulted Bid. Default Administration Fee. A fixed administration fee of AED 500 may be charged for the delay and operational work caused by the default. Any revised administration fee must be disclosed before bidding. Additional Costs. The Bidder may also be responsible for reasonable storage, recovery, delivery, redelivery, transfer or other direct costs caused by the default. These amounts may be deducted from the security deposit. If the deposit was waived or is insufficient, the remaining balance continues to be payable to Naximum.
44. Auction and Purchase Cancellation
Before an auction closes, the Auction Partner or Naximum may cancel it. All Bids will then be released. After a Purchase is created, only Naximum may cancel it for a documented reason. If cancellation is not caused by the Bidder, all amounts paid to Naximum for that Purchase will be refunded. Naximum is not responsible for expected resale profit, lost opportunity or other indirect loss resulting from a valid cancellation.
45. Refunds
Where a paid Purchase is cancelled or a dispute is decided in the Bidder's favour, Naximum will initiate the applicable refund within two Working Days after the cancellation or final decision. Any settlement agreed by the parties or valid amount payable by the Bidder may be deducted before refund. Additional processing time required by the receiving bank is outside Naximum's control.
46. Notifications
Naximum may communicate through in-app notifications, push notifications, SMS, WhatsApp, email or telephone. Auction reminders, Interest List alerts and other notifications are provided for convenience. A failure or delay in receiving a notification does not cancel a Bid, extend a deadline or invalidate an auction result. The Bidder remains responsible for monitoring active auctions, Purchases, deadlines and account messages.
47. System Records and Errors
Naximum's electronic records—including bids, timestamps, status changes, notices and account activity' will be used as the primary operational record unless a clear error is established.
If a technical, pricing, timing or administrative error materially affects an auction, Naximum may pause, extend, correct, cancel or rerun the auction where reasonably necessary. Naximum will act reasonably and notify affected Bidders where practical.
48. Account Restrictions and Suspension
Naximum may manually restrict bidding, suspend or terminate a Bidder account where there is:
- Payment or purchase default.
- Misuse of the dispute process.
- False or expired documentation.
- Suspected fraud or unlawful activity.
- Abusive or inappropriate conduct.
- Attempted marketplace circumvention.
- Unauthorized account or device use.
- A material breach of these Terms.
- Conduct creating material risk to Naximum, an Auction Partner or another participant.
Restrictions may remain until outstanding issues and amounts are resolved.
49. Limitation of Responsibility
Auction vehicles are used vehicles supplied by independent Auction Partners. To the extent permitted by applicable law, Naximum is not responsible for normal wear, matters accurately disclosed in the inspection, future mechanical performance or a Bidder's expected resale value. Naximum will not be liable for indirect or consequential loss, loss of profit, business opportunity or anticipated resale income. Nothing in these Terms excludes liability that cannot legally be excluded or limits Naximum's express responsibilities for managed payments, dispute handling or confirmed transaction services.
50. Changes to These Terms
Naximum may update these Terms to reflect operational, service or legal changes. Material changes will be communicated through the system where appropriate. A Bidder may be required to accept the updated Terms before bidding again. Changes will not retrospectively alter a Purchase already created unless required by law or agreed by the affected parties.
51. Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai. Subject to any mandatory legal requirements, the courts of Dubai will have exclusive jurisdiction over disputes arising from these Terms or use of the auction service.
52. General Provisions
If part of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply.
A delay or failure by Naximum to enforce a right does not waive that right. These Terms operate together with the Privacy Policy, Inspection and Dispute Policy, auction-specific information and Purchase details shown in the system. These Terms may be published in English and Arabic. If the versions differ, the English version will prevail to the extent permitted by applicable law.

54. Vehicle Inspection and Dispute Policy
This Policy explains how auction vehicles are inspected, what Bidders should review before bidding, when a vehicle may be rejected at handover, how inspection disputes are submitted and decided, and who is responsible for resulting costs. This Policy forms part of the Bidder Terms and Auction Rules.
55. Who Performs the Original Inspection
The original vehicle inspection is performed by the Auction Partner that submits the vehicle. Naximum provides inspection standards, training and monitoring to promote consistent and reliable reports. However, Naximum does not perform the Auction Partner's original inspection unless expressly stated. The Auction Partner is responsible for inspecting the vehicle properly, providing complete and accurate information, recording material visible or detectable defects, uploading clear supporting photographs, removing identifying partner or seller information, and confirming that the vehicle condition remains materially unchanged before handover. Naximum may restrict or suspend an Auction Partner that repeatedly submits inaccurate inspections or violates the inspection standards.
56. Used-Vehicle Condition
Every auction vehicle is a used vehicle unless expressly stated otherwise. A used vehicle should not be expected to have the appearance, performance or condition of a new vehicle. Reasonable wear must be assessed according to the vehicle's age, mileage, type, intended use, general condition and comparable vehicles. Some defects are minor, and some condition assessments depend partly on professional opinion rather than an absolute fact. The inspection should identify material defects that may reasonably reduce the vehicle's value compared with similar vehicles of comparable age and mileage.
57. Scope of the Inspection
The inspection report may include vehicle identity and specifications, exterior and body condition, previous repairs or paintwork, interior condition, engine and transmission, electrical systems, tyres, wheels, brakes, suspension, accident or structural indicators, mileage, photographs, ratings and comments. The exact scope may vary according to the vehicle and inspection package shown in the auction. The inspection is not a warranty, certification of future performance or guarantee that the vehicle will require no maintenance.
58. Bidder Responsibility Before Bidding
Before submitting a Bid, the Bidder must review the complete inspection report, photographs, videos, specifications, mileage, disclosed defects, repairs, notes and stated limitations. Submitting a Bid confirms that the Bidder has reviewed and accepted the disclosed vehicle information. The Bidder should not bid if further information is required to make a professional purchasing decision.
59. Condition Changes Before Handover
The Auction Partner must notify Naximum if the vehicle's condition materially changes after inspection and before handover. Naximum may update the auction information, notify affected Bidders, pause, extend or cancel the auction, require another inspection, or cancel a Purchase where the change is identified after closing.
60. Inspection at Handover
The Bidder must inspect the vehicle at pickup or delivery before accepting it. The handover review allows the Bidder to confirm that the vehicle reasonably matches the original inspection report. The review must be completed promptly and without dismantling, damaging, repairing or materially altering the vehicle. The Bidder must either accept the vehicle or reject it immediately and submit an inspection dispute. The vehicle cannot be accepted conditionally unless Naximum records an agreed settlement.
61. Effect of Vehicle Acceptance
Once the Bidder accepts the vehicle at handover, no later claim may be made for visible defects, disclosed defects, condition differences reasonably identifiable during handover or normal wear appropriate to age and mileage. This does not remove rights relating to ownership, fraud or a defect deliberately concealed from the Bidder.
62. Valid Grounds for Rejection
A Bidder may reject the vehicle only for a material inspection mismatch. This may include an undisclosed condition that materially affects safe or normal operation, materially reduces value compared with similar vehicles, contradicts an important inspection statement, shows significant undisclosed accident, structural, fire or flood damage, involves a significant undisclosed mechanical or electrical defect, shows a material mileage, specification or identity discrepancy, or involves missing major equipment shown as present. Each case is assessed according to its evidence and circumstances.
63. Matters That Normally Do Not Justify Rejection
The following do not normally qualify as valid rejection grounds:
- Normal age-related wear.
- Minor scratches, dents, marks or cosmetic imperfections.
- Normal wear to tyres, brakes, batteries or other consumable items.
- A condition already visible or disclosed.
- Small differences based mainly on personal opinion.
- Properly disclosed previous repairs or paintwork.
- A change of mind.
- A change in market value or expected resale profit.
- A defect arising after acceptance or caused by the Bidder.
- A difference that does not materially affect condition or reasonable market value.
Several minor undisclosed defects may be considered together if their combined effect is material.
64. Submitting a Dispute
A dispute must be submitted through the Naximum system at handover and before the vehicle is accepted. The Bidder must select the relevant inspection items, describe each claimed mismatch clearly, add comments explaining materiality, provide photographs or videos where requested, cooperate with reinspection, and keep the vehicle available and unchanged. A general statement that the vehicle is 'not as expected' is not sufficient.
65. Required Bidder Confirmations
Before submitting the dispute, the Bidder must confirm:
- I have reviewed the vehicle, Purchase details and original inspection report.
- I confirm that the reported defects and supporting information are accurate to the best of my knowledge and represent material differences from the original inspection.
- I understand that submitting this dispute rejects the vehicle and starts the dispute-resolution process.
- I agree to comply with Naximum's final operational decision, including completing the Purchase and paying applicable administration, reinspection, delivery or other charges if my claim is not confirmed.
The dispute cannot be submitted unless all required confirmations are accepted.
66. Preserving the Vehicle
After a dispute is submitted, the vehicle must remain at the handover location unless Naximum instructs otherwise. The vehicle must not be driven, moved, repaired, dismantled, cleaned in a way that removes evidence, connected to equipment that changes its condition, altered or used. Unauthorized movement or alteration may affect the decision and make the Bidder responsible for resulting costs.
67. Appointment of a Reinspector
The vehicle will be reinspected by an inspector appointed by Naximum. The appointed inspector may be a qualified member of the Naximum team or an independent inspection company or specialist.
Neither the Auction Partner nor the Bidder may select or control the appointed inspector. Naximum may request specialist assessment where required.
68. Reinspection Timing
Reinspection will be arranged as quickly as practical. For a dispute raised during pickup, reinspection will normally begin immediately or on the same day. For a dispute raised during delivery, the vehicle may need to be transported to Naximum's designated reinspection location. Reinspection will normally be completed within two Working Days after the vehicle reaches that location. Timing may be extended where specialist testing, additional evidence or circumstances outside Naximum's reasonable control require more time.
69. Assessment Standard
The reinspection will consider the original inspection report, condition at handover, Bidder evidence, Auction Partner information, disclosure, reasonable age and mileage expectations, material effect on value or operation, and whether the vehicle was moved or altered. The objective is to determine whether a material inspection mismatch existed'not whether the vehicle is free from every defect.
70. Dispute Decision
Naximum will normally issue its decision on the same day the reinspection is completed. If additional evidence or specialist input is required, the decision will normally be issued no later than the next Working Day. The decision will be recorded in the Naximum system and communicated to the Bidder and Auction Partner.
71. Confirmed Bidder Claim
If the Bidder's claim is confirmed, Naximum may cancel the Purchase and arrange return of the vehicle or facilitate a financial settlement agreed by the Bidder and Auction Partner. If cancelled, the Bidder is not required to accept the vehicle, refundable amounts are returned, and applicable reinspection, return-delivery and related costs are charged to the Auction Partner.
72. Agreed Settlement
The Bidder and Auction Partner may agree to complete the Purchase with a financial settlement reflecting the confirmed condition difference. The settlement must be approved and recorded through Naximum, accepted by both parties, and reflected in the Purchase or settlement records. Neither party is required to accept a proposed settlement. If no settlement is agreed after the claim is confirmed, the Purchase will normally be cancelled and the vehicle returned.
73. Unconfirmed Bidder Claim
If the Bidder's claim is not confirmed, the Purchase remains binding, the Bidder must accept the vehicle, payment and ownership transfer must be completed, and the Bidder may be charged applicable administration, reinspection, delivery, redelivery and storage costs. A Bidder cannot use the dispute process to delay payment, withdraw a Bid or renegotiate for reasons unrelated to a material inspection mismatch.
74. Allocation of Costs
If the Bidder's claim is confirmed, the Auction Partner is responsible for applicable reinspection and vehicle-return costs. If the claim is rejected, the Bidder is responsible for applicable administration, reinspection, delivery, redelivery and storage costs. If only some issues are confirmed, Naximum may allocate costs reasonably according to the material outcome or an agreed settlement. All applicable charges must be recorded in the system or supporting documents.
75. Refund Timing
Where a dispute results in Purchase cancellation, Naximum will initiate the applicable refund within two Working Days after the final decision. Any agreed settlement or valid amount payable by the Bidder may be deducted before refund. Additional processing time required by the receiving bank is outside Naximum's control.
76. Final Decision and New Evidence
Naximum's decision is final for operational purposes. There is no automatic internal appeal. However, Naximum may reopen a dispute if material new evidence is submitted before ownership transfer or refund completion. This does not limit any right that cannot be excluded under applicable law.
77. Ownership or Fraud Concerns
A concern involving vehicle ownership, falsified documents, fraud or deliberate concealment may be handled outside the standard inspection-dispute process. Naximum may suspend the transaction, request documents, contact relevant parties or authorities and take action reasonably required to protect the transaction.
78. Misuse of the Dispute Process
Naximum may restrict or suspend a Bidder that repeatedly submits claims without a reasonable basis, provides false evidence, alters disputed vehicles, uses disputes to avoid binding Purchases, or refuses to comply with final decisions or pay applicable charges. Similar action may be taken against an Auction Partner that repeatedly provides inaccurate inspections or fails to comply with inspection standards.
79. Changes to This Policy
Naximum may update this Policy to reflect operational, technical or legal changes. Material changes will be communicated through the system where appropriate. Updated rules will not normally change a dispute already submitted unless required by law or agreed by the affected parties.
